Bill Summary:
Workers' compensation; failure to market residual
capacity. Provides that an employee is not barred from receiving
workers' compensation benefits due to a failure to market residual
work capacity if credible evidence supports that the employee (i)
is reasonably unemployable based upon age, education, work history,
or medical conditions or (ii) is employable in some capacity and
has registered with the Virginia Employment Commission.
